By placing an order for Products through our website, you agree to be bound by these Terms. Please read them carefully before placing an order.

2.1 Handmade Nature: Our pottery items are individually handcrafted. This means that each piece is unique and may exhibit slight variations in colour, size, texture, glaze, and finish compared to the images shown on our website. These variations are inherent characteristics of handmade products and are not considered defects. We strive to represent our Products as accurately as possible, but due to the handmade nature and differences in screen displays, the actual Product may vary slightly.

2.2 Descriptions and Availability: We take reasonable care to ensure that all details, descriptions, and prices of Products appearing on the website are correct at the time when the information was entered onto the system. However, we reserve the right to refuse orders where product information has been mispublished, including prices and promotions. All Products are subject to availability.

 

3. Placing an Order

 

3.1 Order Process: To place an order, you will follow the steps indicated on the website, which typically involves selecting items, adding them to your basket, proceeding to checkout, providing shipping and billing information, and making payment.

The contract between us ("Contract") will only be formed when we send you the Dispatch Confirmation.

6. Your Rights to Cancel (UK Consumers - Consumer Contracts Regulations 2013)

 

6.1 Right to Cancel: If you are a consumer in the UK, you have a legal right to cancel a Contract under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 during the period set out below in clause 6.2. This means that during the relevant period, if you change your mind or decide for any other reason that you do not want to receive or keep a Product, you can notify us of your decision to cancel the Contract and receive a refund.

6.2 Cancellation Period: Your right to cancel a Contract starts from the date of the Dispatch Confirmation (the date on which we email you to confirm our acceptance of your order, which is when the Contract between us is formed). Your deadline for cancelling the Contract then depends on what you have ordered and how it is delivered, as set out below: * If your order is for a single Product (or multiple Products delivered on the same day): You have 14 days after the day you receive the Product. * If your order is for multiple Products delivered on different days: You have 14 days after the day you receive the last of the Products.

 

6.3 Exercising Your Right to Cancel: To cancel a Contract, you just need to let us know that you have decided to cancel. You may use the model cancellation form provided in Schedule 3 of the Consumer Contracts Regulations 2013, but it is not obligatory.

6.4 Effect of Cancellation: If you cancel a Contract, we will: * Refund you the price you paid for the Products. * Refund any standard delivery costs you paid. However, we are permitted by law to reduce your refund to reflect any reduction in the value of the goods, if this has been caused by your handling them in a way which would not be permitted in a shop. If we refund you the price paid before we are able to inspect the goods, and later discover you have handled them in an unacceptable way, you must pay us an appropriate amount. * Not refund any supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us. * Make the refund as soon as possible and in any event within 14 days after the day on which we receive the Product back from you or, if earlier, the day on which you provide us with evidence that you have sent the Product back to us.

6.5 Returning Products After Cancellation: If you cancel a Contract under clause 6.1 and 6.2 and the Products have been dispatched to you, you must return them to us without undue delay and in any event not later than 14 days after the day on which you let us know that you wish to cancel the Contract. You will be responsible for the cost of returning the Products to us. Please ensure Products are returned in their original packaging and are adequately protected, as fragile items are your responsibility until they reach us.

 

7. Faulty or Damaged Goods (Consumer Rights Act 2015)

 

7.1 Your Rights: As a consumer, you have legal rights in relation to Products that are faulty or not as described. Under the Consumer Rights Act 2015, goods must be of satisfactory quality, fit for purpose, and as described. * Within 30 days: If your Product is faulty, you are entitled to a full refund within 30 days of purchase. * After 30 days (up to 6 months): After 30 days and up to six months from purchase, we have the opportunity to repair or replace the faulty item. If a repair or replacement is not possible or is unsuccessful, you are entitled to a full refund. * After 6 months:After six months, you may still be entitled to a repair or replacement, but you would need to prove the fault was present at the time of purchase.

7.2 Reporting Faults/Damage: If a Product you have received is faulty or damaged on arrival, please contact us immediately (within [e.g., 48 hours] of delivery) by emailing [Your contact email address] with your order number, a description of the fault/damage, and clear photographic evidence of the fault/damage and the packaging.

8. Liability

 

8.1 Nothing in these Terms limits or excludes our liability for: * death or personal injury caused by our negligence; * fraud or fraudulent misrepresentation; * breach of the terms implied by section 12 of the Sale of Goods Act 1979 (title and quiet possession); * defective products under the Consumer Protection Act 1987; or * any other liability that cannot be limited or excluded by law.

 

8.2 Subject to clause 8.1, we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it was an obvious consequence of our breach or if it was contemplated by you and us at the time we entered into this Contract.

8.3 We only supply the Products for domestic and private use. You agree not to use the Product for any commercial, business, or re-sale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

 

 

9. Events Outside Our Control

 

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by an Event Outside Our Control. An "Event Outside Our Control" means any act or event beyond our reasonable control, including without limitation strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic, pandemic or other natural disaster, or failure of public or private telecommunications networks.

 

10. Other Important Terms

 

10.1 Transfer of Rights: We may transfer our rights and obligations under a Contract to another organisation, but this will not affect your rights or our obligations under these Terms.

10.2 Severability: Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.

10.3 Waiver: If we do not insist immediately that you do anything you are required to do under these Terms, or if we delay in taking steps against you in respect of your breaking this Contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.

10.4 Entire Agreement: These Terms constitute the entire agreement between you and us in relation to your purchase of Products from our website.

10.5 Governing Law and Jurisdiction: These Terms are governed by English law. This means a Contract for the purchase of Products through our site and any dispute or claim arising out of or in connection with it will be governed by English law. You and we both agree that the courts of England and Wales will have exclusive jurisdiction.
